PacWest/Hanson 6-figure Settlement Agreement
On September 12, 2023, Workforce Defense League (“WDL”) filed a civil lawsuit against general contractor Pacific West Builders, Inc. and one of its subcontractors, alleging that they had failed to pay all wages owed to workers on Pacific West’s Brunswick Commons, Cedar Lane Family Apartments, Cedar Grove Apartments, and Ford Oak Apartments projects (“Projects”).
The lawsuit alleged that the defendants failed to pay two of the workers any wages for their work on the Projects, failed to pay the remaining workers all regular wages owed, and failed to pay overtime wages to any workers, even though all workers regularly worked more than eight hours in a day or forty hours in a week on the Projects. The lawsuit further alleged that the defendants failed to schedule or provide the workers with any rest breaks on the Projects, despite being legally required to do so. The lawsuit was settled out of court. Under the terms of the six-figure settlement agreement, the subcontractor paid all of the workers’ unpaid wages with interest, all penalties for associated violations of the Labor Code, and all WDL’s attorneys’ fees and costs.
